2. Governmental Agencies and Regulatory References

This website may reference governmental agencies, regulatory requirements, standards, guidance documents or other recognized environmental, health and safety resources.

These references may include, among others:

Reference Does Not Mean Affiliation

References to governmental agencies, regulations, standards, guidance or requirements are intended to describe areas in which US-EHS may provide professional consulting, training, compliance assistance or related environmental, health and safety services.

The use of an agency name, acronym, regulation or standard does not by itself indicate governmental affiliation, sponsorship, endorsement, authorization or approval of US-EHS.

3. No Governmental Authority

US-EHS does not issue governmental citations, penalties, regulatory determinations, official agency interpretations, licenses or enforcement decisions.

Nothing presented on this website should be interpreted as an exercise of governmental authority.

Questions requiring an official interpretation or determination from a governmental agency should be directed to the appropriate agency or other authorized authority.

4. Regulations and Standards May Change

Environmental, occupational safety, health, transportation, construction, mining and other requirements may be amended, revised, interpreted or replaced over time.

Applicable requirements may also differ based on:

Visitors should confirm the current requirements applicable to their specific operations and circumstances.

5. Professional Consulting and Compliance Assistance

US-EHS may provide professional environmental, health and safety consulting, compliance assistance, inspections, audits, assessments, program development, documentation support, training and related professional services.

The scope of a particular engagement is determined by the applicable proposal, agreement, authorization, scope of work or other arrangement between US-EHS and the client.

General descriptions appearing on this website do not establish the scope or obligations of a specific professional engagement.

6. Employer Responsibility

Employers and other responsible parties remain responsible for understanding and complying with the laws, regulations, standards, contract requirements and workplace obligations applicable to their operations.

The use of consultants, trainers, inspectors or other professional service providers does not automatically transfer an employer's or responsible party's legal obligations to US-EHS.

7. Training Disclaimer

US-EHS provides professional training and educational services in environmental health, occupational safety, hazard recognition, workforce development and related subject areas.

Training is intended to support knowledge, awareness, prevention and professional development.

Completion of a course does not automatically establish that an individual satisfies every employer-specific, project-specific, contractual or regulatory qualification that may apply to a particular assignment.

8. Competent Person and Authorized Person Responsibilities

Certain regulations and workplace requirements may require an employer or other responsible party to identify, designate, authorize or evaluate individuals for specific duties or roles.

Where such designation or authorization is required, completion of training alone does not replace the employer's or responsible party's obligation to make the applicable determination based on the requirements governing the work being performed.

9. Certificates and Training Records

Where US-EHS issues a certificate, card, training record or other documentation, that document identifies the training or service provided by US-EHS as described on the applicable document.

A US-EHS training document should not be represented as a government-issued license, credential or certification unless the document expressly states otherwise and such representation is supported by the applicable program requirements.

10. Safety Outcomes

Environmental health and workplace safety depend on many factors, including management commitment, employee participation, hazard control, supervision, equipment, workplace conditions, training, implementation of procedures and ongoing compliance efforts.

No consulting service, inspection, audit, training program, written program or recommendation can guarantee that an accident, injury, illness, citation, penalty, environmental event, property loss or other adverse event will never occur.

11. Inspections and Audits

An inspection, audit, assessment or site observation reflects conditions and information available within the scope and time of the service performed.

The absence of an observation in a report should not automatically be interpreted to mean that no other hazard, deficiency or compliance issue exists.

Workplace conditions can change before, during and after an inspection or assessment.

12. Written Programs and Documentation

US-EHS may assist clients with health and safety manuals, written safety programs, site-specific plans, policies, procedures, Job Hazard Analyses (JHA), Job Safety Analyses (JSA), emergency action plans and other EHS documentation.

Clients remain responsible for implementing, maintaining and updating documentation as necessary for their operations and for ensuring that workplace practices are consistent with applicable requirements.

13. No Legal, Medical or Engineering Advice

Unless expressly included within an authorized professional scope and provided by an appropriately qualified professional, general information appearing on this website should not be interpreted as legal, medical, engineering, tax or other professional advice outside the environmental health and safety services specifically offered by US-EHS.

Organizations should consult appropriately qualified professionals when specialized advice outside the scope of US-EHS services is required.
